(By Brian Su) You are so blessed by the USCIS, your EB-5 regional center has finally been approved! It is the very first step of your long journey of raising EB-5 capital for your project. If you are targeting Chinese market, you either work directly with Chinese emigration companies (agents) or indirectly work with them through a market consultant. If you choose to directly work with emigration agents, you must ensure that these companies are bonded, licensed, registered with the Chinese Ministry of Public Security (Exit and Entry Administration division of local provinces or municipalities). There are over 600 licensed emigration companies, and about one of every six may work on EB-5 program. However, the market is mainly controlled by a few larger companies in Shanghai, Beijing and Guangdong Province. Conducting due diligence and fully understanding their capabilities are very important prior to fully engaging with Chinese emigration agents.
If you prefer to work with a local market consultant which does not have an emigration service license in China and have the consultant fully manage your project on the ground in China, the independent consultant must have a lot knowledge about EB-5 program and multi-year experiences in dealing with local emigration agencies; he or she must fully understand the needs of emigration agents and prospective investors; the consultant should be familiar with local government regulations and emigration industry in a country where your project is represented. The consultant must be able to directly communicate with emigration agents and investors without language and cultural barriers. Certainly asking for references and seeing track records are important. One thing is critical is to find out their reputation in the marketplace prior to hiring an EB-5 market consultant who plays a critical role for your business! Additional caution is always needed in a chaotic and wild marketplace in China.
