    Attorney Karen Caco To Film EB-5 Regional Centers

    It was 2007 when Karen Caco and Michael Gibson last set out to film EB-5 regional center projects, and the number of regional centers at that time was less than half of what it is now. Certainly a lot has changed since then, and both Karen and Michael have already begun another ambitious round of filming – interviewing regional center principals and capturing footage of EB-5 projects across the United States.


    Karen Caco of International Immigration Services, PA (“IIS”) has started her filming of the EB-5 Regional Centers throughout the United States.  The first filming will be done in Northern California and starts next week.  IIS Associate Attorney Brandon Meyer is accompanying her. They are filming 3 Regional Centers at this time; Northern California Regional Center (http://www.eb5northerncalifornia.com/) in Stockton, CMB, McClellan Park in Sacramento (http://www.cmbeb5visa.com/) and California Global Alliance (http://www.eb5immigrationca.com/ ) in Selma. Remaining the only Attorney in the world to actually visit and film the Regional Centers and their projects, this is the second trip for Karen Caco. The inaugural tour and filming was undertaken in 2007 when there were less than 20 Regional Centers in the United States.  At the time, she completed the filming in collaboration with Michael Gibson.  Today with more than 80 Regional Centers, both have decided that it made more sense to divide up the filming of these 80+ Regional Centers throughout the remainder of 2010. Karen and Brandon will conduct interviews and collect film footage that will be used for future DVD’s and media with US Advisors.  Filming the production for IIS is Javier Araujo with 360 Image Design, a well-known professional artist, photographer and videographer.

    As many US EB-5 Regional Centers are receiving calls or emails from migration brokers and consulting firms from China on a regular basis, the questions are whether they could be trusted since most of them would claim that they have offices around the country or/and they would be able to sell your projects quickly if they were granted exclusive marketing rights. There are over 500 licensed migration brokers in China, and numerous consulting firms owned by Chinese and/or Westerners are also involved in EB-5 marketing to Chinese investors.  Before you sign up any Chinese brokers or non-licensed marketing consultants, you need to double check their background and reputation, sometimes even the most reputable migration agencies may mislead their Chinese customers by making false statements because they want the project sold and collect their finders fees. As an EB-5 Regional Center principal, you have the obligation and responsibilities to ensure your Chinese brokers comply with Chinese outbound migration regulations. Conducting on-going due diligence and monitoring your Chinese partners are key to success in China.  Here are some incidents:

    • An unlicensed consultancy ran a classified migration service ad with a Nanjing newspaper, two days later local police officers raided the business owned by a Westerner as the company was not licensed to conduct international migration services. 
    • Two Chinese consulting firms that promoted US investment and educational programs in Shenzhen were raided by local police department as they received complaints from Chinese customers.
    • Another unlicensed foreign firm was promoting an immigration investment program with Chinese banks around the country, migration trade association filed complaints with the State Entry/Exit Administration. The foreign firm was publicized and labeled as a "black broker" (illegal broker) by the public and received massive negative media coverage.
    • A Chinese individual that claimed his representation of a southern EB-5 regional center and posted various messages on Chinese Internet bulletin boards offering cash to referrals, we contact the Regional Center who informed us that they had no relationship with the individual.

    An increasing number of Koreans are immigrating to the U.S. through an investment program as the U.S. has loosened immigration restrictions in order to boost its economy hit hard by the global economic crisis.

    In 1990 the U.S. government began granting permanent residency, or green cards, to immigrants who invest over US$1 million in the country, and in 1993 it introduced an immigrant investment program dubbed "Regional Center EB-5 Program" which offers green cards to those who invest at least US$500,000. The number of agencies which file applications for the immigration program on behalf of clients tripled to around 60 to 70 last year from 23 worldwide in 2008.

    Immigration through investment is a popular option especially among parents seeking to have their children educated in the U.S., as the parents and all children aged 21 or under are able to receive green cards. Various benefits come with permanent residency, such as lower tuition fees for U.S. residents. Between 2006 and 2008, 1,454 Koreans obtained green cards via the program, the highest number among 67 countries that participated.

    China topped the list last year with 1,979, but Korea was in second with 903, which was a 30 percent increase from 693 in 2008. Over US$1 billion was invested in the U.S. through the program in 2008, with Koreans estimated to have contributed at least $400 million or 40 percent of the total.

    "I decided to apply for the immigration program with the children's education in mind, although we still live in Korea," said a mother who obtained a green card last July. "I tell other people that immigration through investment is the easiest and quickest way to get a green card."

    According to immigration agencies, two thirds of Koreans who have applied for the program do not live in the U.S. but rather travel between there and Korea for business.
