EB-5 Visa Consulting Firms: To Use or Not to Use

Thursday, 30 September 2010

(Source: Exclusive Visas) With such an economic decline in the United States in recent years, foreign capital is becoming increasingly sought after. The ability to rely primarily on domestic investment and funding sources has put businesses and corporations in a difficult situation. Developers want to know how they can become a government approved EB-5 Regional Center and attract this foreign capital, all the while foreign EB-5 visa-seeking investors want to know exactly which Regional Center they should be investing in and how - what is the safest investment with the least risk and best expected results? - That is the question.
The $500,000 investment into a USCIS approved Regional Center conditionally provides the foreign investor and the investor's immediate family (unmarried children under 21) with an EB-5 visa green card. Provided that the investment either directly or indirectly creates 10 jobs, issuance of an EB-5 visa administers permanent U.S. residency.
Though it sounds simple enough - with more than 100 approved Regional Centers in the United States - the actual process of selecting the right one can be a difficult decision for any foreign investor, especially when the investor's knowledge on each and every Regional Center and the entire EB-5 process as a whole is much less than distinguished. Given that the investment is fully at risk there is a chance that the chosen center may not meet the requirements. In this case, the investor not only loses their chance of obtaining an EB-5 visa but also loses their money.
Sole reliance on a Regional Center's advertising or expectant results is a risky business and a lot of Regional Centers encourage the investor to work directly with them in investing into their program. This can prove to be a strong disadvantage to the investor and the investor's best interests. If a Regional Center fails to report or misrepresents information it can leave the investor in an unfavorable position. Therefore it is very important to research and compare all options. One way, in particular, is by utilizing a consulting firm. The most esteemed consulting firms play a huge role in acting as a type of unbiased counselor in the EB-5 process; providing due diligence reports, financial projections, assessing risk, reviewing all legal documents and most importantly monitoring the project until completion, the consulter essentially helps to remove most burdens of the investor.
The best consulting firms consist of a team of not only expert consulters but also include financial specialists, economists, SEC attorneys, immigration attorneys, business attorneys, industry researchers and even marketing directors. Clearly, this type of task force possesses the professional background and skill necessary to aide the foreign investor in making the wisest decision on which Regional Center to choose. Unless the potential foreign investor encompasses the education and skills of a lawyer, businessman and marketer, collecting and assessing all relevant data can be a distressing task.
When inquiring about using a potential consulting firm it is important to confirm their credentials; verifying the firm's success rate, especially by way of requesting personal testimonies from previous clients and also discovering what nationalities they have worked with are useful types of information when questioning the firm's practice. Questioning how they are being compensated can provide evidence to the firm's validity as well; if they are being paid by just the client or if they are also receiving kick-backs from certain Regional Centers in an effort to advance all referrals. Another source of credibility is finding out how many Regional Centers their clients have used, the higher the amount - provided they have a high success rate - would generally be a key sign that the consulting firm is legitimate and has experience, which is ultimately what any investor would want.
Expert consulting firm, Exclusive Visas, works with clients whose nationalities range from Indian, Chinese, Venezuelan and even Russian. It comes as no surprise that they are the leading consulting firm pertaining to EB-5 visas on the market today. South Atlantic Regional Center Chooses NES Financial EB-5 Administration Solution to Bring Security and Transparency to Investors

SAN JOSE , CALIF. and PALM BEACH, FL, September 29, 2010 – NES Financial (NESF), .a leading provider of financial services solutions for the banking industry, EB-5 Regional Centers and Fortune 500 companies, has announced that the South Atlantic Regional Center (SARC) has selected the NESF EB-5 Escrow Administration Solution to administer funds associated with its EB-5 visa program.

SARC required a solution that provided an efficient overall structure, simplified account setup, rapid implementation, and straightforward administration.  In addition the solution needed to provide security and transparency for the investments from overseas investor applicants.

“NES Financial is highly experienced, extremely professional, and their eSTAC-based technology addressed all of my needs – after my first meeting with them it became clear why they’ve become known as the ‘go-to’ company for EB-5 Regional Center solutions,” said Joseph J. Walsh, president of the South Atlantic Regional Center.  “With NESF’s EB-5 Administration Solution we were up and running quickly, providing our investors with visibility into their funds -- bringing a sense of security and transparency to the whole process and putting each investor at ease.”

The federally-sanctioned EB-5 visa program encourages investment in government-approved projects that create U.S. jobs and provide the opportunity for foreign nationals to become lawful permanent residents.  A foreign investor invests $500,000 into a project, and Regional Centers like SARC hold each visa applicant’s deposit in escrow pending approval by the U.S. Citizenship and Immigration Services

Since high dollar amounts are required from each applicant investor, funds from a single investor can sometimes be comprised of a number of smaller deposits.  NES Financial has substantial subject matter expertise and the company understands the nuances of EB-5 international wire transfers and local currency restrictions.  As a result, their EB-5 Administration Solution can easily address these issues.

“We are thrilled to have been selected by the South Atlantic Regional Center ,” said Michael Halloran, president and CEO of NES Financial.  “Our robust solution for EB-5 funds administration is delivering the highest level of security and transparency in the marketplace.  These benefits are being recognized by Regional Centers and foreign investors alike which is contributing to our leadership position in this marketplace.”

The NES Financial EB-5 Administration Solution brings Regional Centers a unique approach providing rapid system implementation of easy, automated deposit administration solutions.  Combining proven, industry-leading software -- proprietary to NESF -- and a client-focused team with decades of financial services experience, NES Financial’s EB-5 Administration Solution delivers immediate benefits for Regional Centers and their investors.

NESF’s solution provides maximum FDIC coverage on individual accounts to ensure unsurpassed levels of funds security.  Investor recordkeeping, customized reporting of subaccounts for assembled funds, and accounting and reconciliation for the investor group, individual investors and the Regional Center is available on-demand, around the clock. Rejected investor accounting, with full accounting provided to the Regional Center for distribution back to the rejected investor is available at a moment’s notice.

For more information on EB-5 solutions for Regional Centers, contact NES Financial at (800) 339-1031 or by visiting www.nesf.com.

Vermont Gov. Douglas seeks investors in Asia

Thursday, 16 September 2010

(Source: WCAX.com) At his weekly press conference Thursday, Gov. Jim Douglas announced he will head to Asia next month in support of the EB-5 program. That's the program that fast tracks green cards for foreigners willing to invest in U.S. companies and able to pass the immigration screening process.
"At a time when capital is hard to come by the EB-5 program is a great asset to Vermont employers who are looking to grow," said Douglas, R-Vermont.
Douglas made a similar trip last year and says that resulted in about $50 million in investments to Vermont businesses, like Jay Peak. The program funded much of Jay's recent expansion.
Overall, Douglas says foreigners have invested more than $100 million in Vermont, creating more than 2,000 jobs.
"More companies are interested in pursuing the program, more investors are interested in what Vermont has to offer," the governor said.
Douglas will travel to Tokyo, Hong Kong, Beijing, Shanghai and Ho Chi Min City. He'll be joined by representatives from several companies, including SB Electronics in Barre.
"Yes we recently learned about the trip from Governor Douglas's office and will be joining him," said Brad Gordon of SB Electronics.
While the company could not confirm its exact purpose for the trip, its presence implies it is hoping to pick up foreign investments. The company is in the midst of a major expansion to triple its work force.
"We're looking to add 130 plus new jobs over the next 5 years. We've already added roughly 24 this year," Gordon said.
While some people have criticized the EB-5 program for allowing people to buy their way into the country, Douglas says it's not up to him to weigh in on that. He is simply helping the state take advantage of an opportunity to grow jobs.
The trip will cost the state about $10,000 but Douglas says numerous Asian companies have told him they'd rather invest with Vermont because they know they have direct access to the governor.

EB-5 China Market Council Issues EB-5 China Market Warning

Tuesday, 14 September 2010

EB-5 China Market Council issues its first warning to EB-5 Regional Centers. In recent months, many EB-5 regional centers have received various solicitations from individuals and commercial entities about their EB-5 promotional event offerings. Please be cautious and alert as the international migration service industry is highly restricted and regulated by the Ministry of Public Security, Exit and Entry Administration, PR China. The Private Exit and Entry and Migration Service Regulations are enforced by Exit and Entry Administration at local and provincial level. Working with unregistered and unbonded agents to openly conduct unregistered events and recruit investors in China is against Chinese law, it will put your Regional Center and projects at risk in China. EB-5 China Market Council works closely with major Chinese Exit and Entry Service Associations to maintain an orderly and healthy market for EB-5 projects and other migration programs in China. For more information and receiving a free copy of Chinese regulation, please contact Council President Mr. Brian Su today.
