A prolific scholar, he has written many law review articles, and is author or co-author of four standard reference works. He was editor-in-chief of The Cornell International Law Journal, and he co-authors a bimonthly column for The New York Law Journal. He teaches immigration and asylum law at Cornell Law School as an adjunct professor, and is of counsel to the Ithaca firm of Miller Mayer. Upon receiving his Cornell J.D. cum laude, Mr. Yale-Loehr clerked for Chief Judge Howard G. Munson of the U.S. District Court for the Northern District of New York. Mr. Yale-Loehr is a member of the New York and District of Columbia bars, the U.S. Court of Appeals for the D.C. Circuit, U.S. District Court for the Northern District of New York and the U.S. Supreme Court. He is vice-chair of the American Immigration Lawyers Association (AILA) business immigration committee. EB-5 Regional Center of the Year - the State of Vermont Regional Center

EB-5 News Blog has given EB-5 Regional Center of the Year title to the State of Vermont Regional Center which is the only state government owned and operated Regional Center in the country. The State of Vermont Regional Center and its approved EB-5 visa projects have significant government backing at the State level from Governor, Jim Douglas and Secretary, Kevin Dorn and at the federal level from United States Senator and Chairman of the Senate Judiciary Committee, Patrick Leahy.  Governor Douglas has recently returned from an EB-5 promotional trade mission to Asia. The Center has been very successful in promoting EB-5 program in international market. Approved State of Vermont Regional Center projects have a "Memorandum-of-Understanding" (MOU) that creates an agreement between the State Government and the private corporation that will be promoting and administering the project. Asian Games open in Guangzhou China

GUANGZHOU, China (AFP) – The Asian Games opened with a spectacular water-themed gala ceremony on Friday, culminating years of planning for an event that is set to reinforce China's regional sporting dominance.
The extravaganza heralds the most ambitious Asiad so far with some 10,000 athletes from 45 countries and territories vying for gold in 42 sports.
The Games run until November 27, with hosts China heavily favoured to top the medal table, and South Korea and Japan battling for second place.
"Remember, you are part of history right here, right now," Olympic Council of Asia president Sheikh Ahmad Al-Fahad Al-Sabah told the athletes at the opening ceremony.
"Please show us your best performance, and show us the spirit of sportsmanship, fair play, friendship and resopect to your fellow athletes and officials."
Security forces mounted a sweeping operation to isolate the fenced-off venue with Chinese Premier Wen Jiabao and Pakistani President Asif Ali Zardari attending.
In a change to standard procedure the ceremony, beamed to a television of audience of billions, was held on an island in the Pearl River rather than a stadium, with the giant Guangzhou Tower as a background.
Backed by a stunning light show, it was themed around the local Lingnan culture, incorporating folk dance, drum music as well as water skiing and jet skiing and a giant ship called "Harmony".
Film starlet Zhang Ziyi and world-renowned pianist Lang Lang performed together in one of the highlights of a show that celebrated Guangzhou's history as China's gateway to the ancient Maritime Silk Road.
The scale of the preparations for the ceremony drew parallels with the Beijing Olympics opener in 2008, which was highly acclaimed, but Guangzhou officials were eager to set the two apart.
"It's like one is coffee and the other is tea," ceremony director Chen Weiya, the assistant chief for the Beijing curtain raiser, said.
Just as Beijing did before the 2008 Olympics, Guangzhou has poured billions of dollars into getting this sprawling southern metropolis ready.
While the city does not have the glamour of Beijing and Shanghai, officials here are hoping the Games will help transform it into one of Asia's top destinations.
In preparation, it has embarked on several huge infrastructure projects -- a new rail station, a gleaming trade centre, subway lines, housing projects, highways and bridges.
It has also constructed or renovated 70 sporting facilities.
Security is a major focus, with more than 100,000 police officers on duty to keep it safe, along with hundreds of thousands of security guards and volunteers.8
"As the Guangzhou Asian Games will have the most ever athletes, officials and reporters in the history of the Asian Games, the security work has been a great challenge," a statement from the Games security panel said.
"The security panel has adopted effective and necessary measures to ensure a safe Games. We have done our best to provide a safe and favorable environment for athletes, coaches, officials and audiences."
While the two Koreas marched together at the 2000 Sydney Olympics, 2004 Athens Olympics and 2006 Doha Asian Games in a sign of reconciliation, they failed to repeat the feat here.
Relations between the two neighbours remain tense after the sinking of South Korean warship, the Cheonan, in March that claimed 46 lives.
All the athletes arrive by a convoy of pleasure boats, including those from war-torn Afghanistan and Iraq, as well as Iran and the Palestinian territories.
The competition proper kicks off on Saturday when 28 gold medals will be won.

Indiana Governor Mitch Daniels Leads 6th Trade Mission to China and Japan

Indiana Governor Mitch Daniels is leading a delegation to China and Japan from November 6 to 17. This will be the sixth trade mission that Daniels has led as governor. Two executives from the state are promoting their EB-5 programs on the trip.. Below is the governor’s daily itinerary for the trip:

Monday, November 8 (China)
Governor Mitch Daniels will speak at a morning conference for business leaders in Shanghai. In the afternoon, the governor will visit several business prospects and host a reception for alumni from Indiana colleges and universities as well as Chinese companies that are interested in locating in the state.

Tuesday, November 9 (China)
Governor Daniels will meet with representatives from Shanghai Top Motor which in April celebrated the grand-opening of a 60,000 square-foot logistics center in Columbus, Ind. for its U.S. subsidiary, Techtop Motor LHP. He will also meet with several life science and electric vehicle companies in Shanghai before hosting a dinner for investment banking groups including CITIC, a state-owned Chinese investment company.

Wednesday, November 10 (China)
The governor will conduct business meetings with suppliers from Cummins, Inc. which is headquartered in Columbus, Ind., before traveling by train to Hangzhou, in Zhejiang Province. There he will meet with Zhao Hongzhu, the Party Secretary of Zhejiang province, who is hosting a banquet to celebrate the 23rd anniversary of the sister-state agreement between Indiana and Zhejiang. Former Governor Robert Orr signed a sister-state agreement with Zhejiang Governor Shen Zulun in Indianapolis on July 23, 1987.

Thursday, November 11 (China)
Governor Daniels will speak at a conference for business leaders in Zhejiang and later will meet with representatives from Wanxiang Group and Geely Motors as a follow-up to the companies’ visits to Indiana earlier this year. In May, representatives from Wanxiang Group and Geely Motors traveled to Indianapolis for the first-ever China-U.S. Advanced Technology Vehicle Summit. During the visit, Wanxiang signed a letter of intent with lithium-ion battery maker, EnerDel to jointly produce battery systems for Wanxiang’s existing backlog of customers in China. Wanxiang is China’s largest auto-parts supplier and second-largest private company, with over $10 billion in annual revenue and 30,000 employees. EnerDel, which is currently ramping production at its three Indiana facilities, said the deal could bring its total central Indiana employment to 3,000 over the next few years. In the evening, Daniels will host a dinner for leaders from the Bank of China and the Chinese Export-Import Bank.

Friday, November 12 (China)
The governor and members of the delegation will meet with several business prospects while traveling to Anji, China, home to Yuankai Furniture, which announced plans in June to locate its U.S. headquarters in Marion and hire up to 100 associates over the next four years.

Saturday, November 13 (China)
Saturday is a non-business day in China so the delegation will take part in cultural tours and host a dinner for local officials from Zhejiang Province.

Sunday, November 14 (China/Japan)
The Indiana delegation will travel from Hangzhou to Tokyo, Japan to continue its economic development mission.

Monday, November 15 (Japan)
Governor Daniels will meet with leaders of Indiana’s three Japanese automobile assembly plants: Honda President Takanobu Ito, Toyota Motor Corporation President Akio Toyoda and Subaru Corporate Executive Vice President J. Kondo. He will also meet with Tochigi Governor Tomikazu Fukuda and ITOCHU Chairman E. Kobayashi. Representatives from ITOCHU, one of the largest general trading firms in Japan, traveled to Indiana last November and joined Secretary of Commerce Mitch Roob to sign a memorandum of understanding signifying the joint exploration of economic growth opportunities.

Tuesday, November 16 (Japan)
The governor and IEDC officials will travel by train to Nagoya to conduct business meetings with prospective companies as well as companies that currently have operations in Indiana including Toyota Industries, Aisin Seiki and Toyoda Boshoku.

Wednesday, November 17 (Japan)
The governor and members of the Indiana delegation will return to Indianapolis from Tokyo.

Governor, Vermont delegation tour Asia on EB-5 mission

A tour of China? Wow, as a youth in school, China was not even on the map, having “disappeared” by decree after the Mao’s liberation. And yet here I was, scrambling to obtain a visa, update my shots, print business cards in Chinese, purchase tickets, and familiarize myself with the EB-5 rules.
The basic conditions of the EB-5 program are: a foreign national may make an at risk equity $500,000 investment in an American enterprise and in return receive temporary green cards for himself, his/her spouse, and their children. Each potential investor must be cleared by the American government and prove that his $500,000 was gained legitimately and that he had this $500,000 asset for as least five years.
The American entrepreneur must prove to the American government that his opportunity will create at least 10 direct or indirect jobs per each $500,000 investment. Further, for the green cards to become permanent, the project must still have 10 jobs per investment two years on. There can be no guaranteed return or interest on the investment, and it may not be repaid for five years.
With that and tickets in hand, we set off for the 12-hour and 57-minute flight from Chicago into the sun, leaving at noon on Thursday and arriving five movies and three meals later in Tokyo on Friday at 3 pm. With the 12-hour time change, day is night and night is day. Departing the aircraft one feels that he has lost his gyroscope hoping not to fall, disoriented like the beetle on its back, saying “which way is up?”
The airport is quiet, almost silent, ones hears only soles of shoes meeting the ground. There is no litter, so clean. We hop on a bus arriving at a five star hotel arranged for us by the State of Vermont. The rush begins. The next day after a walk through the Imperial Palace grounds, we hold our first reception. We dress, set up our displays, and unfortunately host only one firm interested in EB-5 investments.
Falling into bed, we rise at 5 am to meet a 5:40 bus to the airport, and on to Beijing. Unlike Japan, Beijing is neither quiet nor clean. Its scale is massive. The concourse is not 30 feet wide as in America, but 30 yards wide, and full of Chinese. You move like the bevy of swans in Swan Lake with no one tripping over another, just gliding. Once outside you can taste the air. There will be no star gazing in China.
We were off to the hotel for another reception at 4 pm. This turnout is better but remains in single digits. We asked the state what sort of marketing was done to promote these receptions and were told, “None.” We asked the Vermont Chamber of Commerce who assisted in the trip the same question and we were told, “We were only asked to do the logistics in China and Hong Kong.”
One more day in Beijing with a Chamber sponsored lunch and up at 4:45 am and on the bus at 5:30 to fly to Shanghai and another reception at 4 pm. The crowd was larger, 20-30, and the quality was high. Many people had been in attendance the previous year. Governor Douglas had his first opportunity to address the potential a group. It was a collection of investors, agents, public relation experts, and immigration attorneys including three from Montreal, now with offices in both cities.
The quality of the hotels was beyond compare. Your scribe, like Eloise, has stayed at the Plaza and other western five-star hotels. They would compare as a roadside motel beside the Asian hotels with their remarkable attention to detail, unique design elements, service response, spas with steam rooms, cold and hot tubs, pools out of the movies, and attendants to cater to your every need. Total relaxation.
The Vermont King of EB-5 investment is Bill Stenger, president of Jay Peak. He has signed up over 200 international investors from 48 countries. Take a trip to Jay Peak. The bundle of activity, of good-paying construction jobs, is truly a sight to see. Each time I approached the state with an EB-5 question, the answer was “ask Bill Stenger, he knows the most.” So we did.
“I was very disappointed in the turnout in Tokyo and Beijing though we did find two solid prospects in Beijing,” Stenger said. “I was told that the state mailed some database, but clearly it was not effective. Shanghai was strong and the quality of the attendee was high. It was also our second year proving to the investor that we are a fully owned player who is not here today and gone tomorrow. We developed some good relationships. In Hong Kong we had a small but high quality group.”
While most of the group returned home from Hong Kong, Stenger put together his own reception in Ho Chi Ming City (formerly Saigon). Governor Douglas accompanied him.
The governor was remarkable. He was a bundle of energy and good cheer. He made himself available, by appointment, to any of the Vermont delegation for one on one meetings with investors to help close the deal. Investors said that in no other state did they even see a governor let alone sit down with one. Having met Vermont’s governor gave them enhanced credibility and comfort in our Vermont projects.
Stenger and Douglas had high praise for the Vietnamese. Stenger said, “We were very happy with the turnout. We worked for about a month promoting the reception and had 178 turn out and I expect about 30 will invest. There is an emerging middle class with strong entrepreneurial skills.”
Douglas concurred saying, “I found the Vietnamese to be friendly, interested and interesting. They are a people looking for opportunities for their families. There is clearly lots of wealth, a strong work ethic and entrepreneurial strain. For an EB-5 opportunity, Vermont is the only state where the EB office is run by the state. We monitor the program and follow up with the investors and the investments and this gives a level of greater comfort to the investor. We have received very good feedback from both our business community and the investor.”
Stenger concluded by saying, “I am an American who grew up in the time of the Vietnamese war. It was very interesting to me to be here, but it gave me an uneasy feeling seeing traffic signs to Da Nang and the like. I know that the page has turned and I can see that Vietnam today is where China was 15 years ago and equally entrepreneurial. This was the highlight of a good trip for us and I expect that we will be returning early next year.”
