Report from China: Promoting EB-5 Regional Center Projects

For promotion of EB5 regional centers in China, you may consider the following possibilities:

   (1)   Forming an Representative Office in China:

  Quite a number of regional centers have actually done so.

    (2)   Sending a representative to China on business promotion trips: 

  Some US companies (including regional centers) do business in China without having an RO in China.  Their personnel may offer services to Chinese clients on their business trips to China and brief stays.  This model does not work well if the company conducts prolonged, regular course of promotional activities in China, as (i) this will have unfavorable Chinese income tax consequences once a “permanent establishment” is deemed to exist in China, and (ii) this may be regarded by the Chinese government as unlicensed conduct of business.  I would not recommend this method if the Regional Center intends to regularly promote opportunities to potential clients in China and its representative will stay in Chinese cities for months on a trip.

   (3)   Forming alliance with China-based entities:

  Some other regional centers have set up alliances with China-based immigration consulting firms or business consultants for promotion of EB5-related services.  In such alliance, regional centers will provide information on EB5 opportunities to their alliance parties in China, which in turn will offer such leads to their local contacts or potential clients.  Regional center representatives will then travel to China and discuss with potential business immigrants who have been sourced by the center’s local partners.
