Chinese High Court Legal Interpreation's Implications on Chinese Migration Practice and EB-5 Program

The Chinese “Supreme People’s Court on the trial of criminal cases of illegal fund-raising number of issues specific interpretation of application of the law" has major implications on current Chinese migration industry practice and EB-5 marketing in China. The new legal interpretation has a broad coverage of parities and activities involved, including advertising agencies that assisted in public campaign for "illegal fundrai三ing activities" which are defined with following criteria:  1) to attract funds in the form of legitimate business, without obtaining approval from the relevant authority; 2) to publicize through media, presentations, flyers, SMS (phone text messages) and other channels; 3) to promise return of currency in format of cash, property, stock options and other means in a certain time frame; and 4) to absorb funds from the general public.
