North Dakota Receives its first EB-5 regional center designation

Kent Conrad and John Hoeven announced that the Center for Innovation Foundation was approved last week to begin operating as an EB-5 Regional Center, the only one of its kind in North Dakota and Minnesota. How Do Chinese Millionaires Make Their Money?

New figures released by the Hurun Wealth Report indicate that there are 960,000 millionaires in China, up almost 10% from the previous year. 85,000 new millionaires were created in China last year. So how are these millionaires making their money?

According to the report, 55% of China’s millionaires have acquired their wealth through private businesses, 20% are property developers and 15% are stock market speculators. The remaining 10% are company executives. The average age of a Chinese millionaire is 39, which is 15 years younger than Western millionaires. The report estimates that one-third of Chinese millionaires are women.

Dallas Regional Center EB-5 Project Attracts Foreign Investors

The City of Dallas Regional Center has fully subscribed its second project, opening the door to a $30 million multifamily development in North Oak Cliff. The center is funded by contributions from foreign investors participating in the EB-5 regional center pilot program. To date, the program has attracted $23 million of investment capital to the city. The newest contributions are partially funding Zang Triangle, four-story building with 260 apartments being developed by Lang Partners LLC. USCIS Releases EB-5 Training Materials

(Source: IIUSA) In response to a Freedom of Information Act request, USCIS released 486 pages of materials used to train USCIS officers in the adjudication of EB-5 immigrant investor cases. The materials include 446 pages released in their entirety, and 40 pages released in part. USCIS withheld 35 pages in full. Special thanks to H. Hurun Research Institute today released the GroupM Knowledge - Hurun Wealth Report 2011, detailing the number of millionaires broken down by region across China. This is the third year of the report.  China has 960,000 ‘millionaires’ with personal wealth of 10 million Yuan or more (USD 1.5 million), up 85,000 individuals or 9.7% year on year.  In 2009, there were 825,000 millionaires, growing last year to 875,000.

Rising property prices and a fast-growing GDP have been the key drivers for the growth in the number of these millionaires. Property prices in 2010 rose across the country by 13.7% according to a government report, with luxury property prices rising even faster.

Of the 960,000 millionaires, 55% derived their wealth from their private business.  20% are property speculators, who have ridden the fast hike in home prices. 15% are stock market gurus, who are also the youngest with an average age of 38. The remaining 10% are high earning salaried executives.The Chinese millionaire is born in 1972, and today is 39 years, a full fifteen years younger than their Western counterparts.30% of the millionaires are female.

“China’s millionaires are fast becoming sophisticated and aspire towards higher social status” said Rupert Hoogewerf. “Four out of five millionaires, for example, are thinking of sending their children to study overseas, with the US and UK their preferred destinations. The richer they are, the younger they seem to want to send their children overseas.”

60,000 Super Rich
China has 60,000 ‘super rich’ with 100 million Yuan or more, up 9.0% on last year.

Beijing leads the way with 10,000 individuals followed by Guangdong with 9,000 and Shanghai with 7,800.

The average age of the super rich is 43 years. These super rich tend to own three properties, five luxury watches and four cars. There has been a surge of interest in drinking fine wines and collecting art, especially Chinese classical art. This year they are looking to add a holiday home, with Sanya their destination of choice.

Hidden Wealth
“There is still a great deal of hidden wealth in the Chinese economy," said Rupert Hoogewerf. “We estimate there to be 4000 Renminbi billionaires in China, with only a third making the Hurun Rich List.”

In 2010, an RC client wanted to plan some China events.  Although I like to think of myself as a seasoned veteran in that part of the world, it's been 14 years since I closed my satellite offices in Hong Kong and Manila;  when I last had an office there, Hong Kong was still an independant British protectorate, returning to Chinese authority in 1997!  Fourteen year old expertise is an oxymoron, needless to say.


Accordingly, I did what all intrepid attorneys do: I Googled. Then I Googled some more.  Then I called a few friends here and there.  And then I Yahooed.  All roads - and I do mean all roads -- led to Brian Su.  My initial reaction was that perhaps I'd finally found a guy better at marketing himself than me, a Deepak Chopra of EB5dom, if you will.  'Twas indeed the case, but for different reasons: Brian was the ubiquitous name not because of his self-promotion but, rather, because of the unique role he has carved out as the primary resource on EB-5 marketing in China available to the EB-5 industry, plain and simple.


I called Brian and he was as approachable as anyone with whom I've ever bantered EB-5 matters.  That led to another call with the client.  After patiently explaining the nature of EB-5 marketing in China to us and going over his services and fees, Brian did what many in the EB-5 sector simply would never do: he told us that he didn't think we were ready for China yet.  He explained that the client's project needed to have certain things in place and that he'd be happy to help us when it was time, but that he didn't want to take my client's money when he didn't think he could achieve their objectives as stated.  In an industry sector where mediocre attorneys with little understanding of the EB-5 routinely send spam touting their "expert" $75,000 EB-5 Regional Center formation services to clueless, cash-hungry developers, an honest man turning away a paying client is a notable contrast!
And so, like so many before me, I am an unabashed member of the "EB-5 in China = Brian Su" Fan Club.

Characteristics of Chinese EB-5 Investors

Many immigration attorneys have asked me about EB-5 investors from China.  The majority of Chinese EB-5 investors share the following characteristics:
Who Are They?
- Mostly male, married, between 40-50 years of age
- Private business owners, individuals who made wealthy through investment in stocks and real estate
- The Chinese are willing and eager to invest in the U.S.

Where Are They Coming from?
- Shanghai, Beijing, Guangzhou, Shenzhen, ChongQing and 2nd tier cities such as Hangzhou, Shenyang, Chengdu, etc.

What Do They Like?
- Projects in areas with large Asian or Chinese population – They want to stay closer to their own culture, food, language and media.
- Want Green Cards, also prefer to have a real estate unit in the investment exit strategy. Chinese love real estate.
- Better (perceived) value or return with low risk – they expect good ROI and little risk!

What Are the Motivations to Invest Overseas?
- For the sake of their own children’s education, safety and future
- Protecting personal assets and family fortune
- Seeking permanent residency (Green Card)  and new business opportunities in the U.S.
