Subject: Retiree Healthcare-well, once again all four funds jumped to support the city against our motion to revive the Korshak litigation; the judge ruled that we must start a new action, file a new complaint in a new case.
 
To our Participants,
 
I regret to advise you that the Police, Fire and Municipal Funds’ trustees all leaped to support the city’s opposition to our reviving the Korshak litigation. (The laborers fund trustees did not have a counsel attending, so I cannot say what their position is.)
The judge ruled that we must file a new complaint in a new action.
This increases the costs, and time of course.
For those of you who have signed contingent fee agreements with us, we will put together a new complaint listing each of you,
And file it shortly. (tell us immediately if you do not want your name listed as a plaintiff).
The next time you have contact with your Fund’s offices, You might consider asking them why they want to frustrate our efforts for their participants.
